ICC grants extension to prosecution team to submit docs for Duterte case

The International Criminal Court’s (ICC) Pre-Trial Chamber 1 has granted a request from prosecutors to extend the deadline for submitting key documents in the case against former Philippine President Rodrigo Duterte.

In a decision dated May 20, 2025, the Chamber’s three judges approved a revised schedule for the submission of critical filings:

  • June 16, 2025 – Deadline for the prosecution to submit requests for redactions, including the concealment of witness identities or the non-disclosure of certain pieces of evidence. The same date applies to the Victims and Witnesses Unit, which must submit its observations on any redaction requests.
  • June 20, 2025 – Deadline for submitting responses to the aforementioned applications.
  • July 1, 2025 – Deadline for the prosecution to disclose the materials supporting the arrest warrant as they pertain to relevant witnesses named in the case.

Duterte was surrendered to the ICC in The Hague on March 14. The Pre-Trial Chamber had originally ordered the prosecution to submit all supporting materials by March 21. That deadline was first extended to May 9, during which prosecutors submitted a new set of documents and requested additional time to complete their disclosures.

The Chamber noted that the defense raised no objections to the prosecution’s request and ruled that the prosecution had demonstrated sufficient justification for an extension, in accordance with ICC regulations.

Duterte’s pre-trial hearing is scheduled for September 23, 2025.
