ICC declares Rodrigo Duterte fit to stand trial for crimes against humanity

MANILA – The International Criminal Court (ICC) Trial Chamber III has declared former President Rodrigo Duterte fit to stand trial in connection with the crimes against humanity case against him.

In a 17-page decision, the international tribunal ruled that Duterte has the capacity to understand and participate effectively in the proceedings, allowing the case to move forward.

“The Chamber is satisfied that the accused is able to effectively exercise his fair trial rights in the proceedings and is therefore fit to stand trial,” the chamber said.

According to the ICC, the ruling was based on the findings of an independent panel of experts, as well as submissions from the parties and participants involved in the proceedings.

The expert panel determined that Duterte possesses the mental capacity to understand the charges against him, the purpose of the proceedings and their possible consequences.

The panel also found that the former president could follow the course of the trial, comprehend the evidence presented and provide instructions to his legal counsel in preparing his defense.

The chamber’s decision addresses Duterte’s fitness to participate in the proceedings and does not determine his guilt or innocence.

The former president faces allegations of crimes against humanity in connection with killings linked to his administration’s anti-drug campaign.

His trial before the ICC is scheduled to begin on November 30, 2026.
