The International Criminal Court (ICC) has officially cleared former Philippine President Rodrigo Duterte for trial, ruling on Monday that the 80-year-old is medically and mentally fit to face charges of crimes against humanity.
Following a comprehensive evaluation by a panel of independent medical experts, Pre-Trial Chamber I rejected a request from Duterte’s legal team for an indefinite postponement.
His lawyers had previously argued that the former leader was suffering from “cognitive impairment” and physical frailty that would prevent him from meaningfully participating in his defense.
However, the three-member medical panel—which included specialists in geriatric neurology and psychiatry—unanimously concluded that while Duterte exhibits signs of aging, he remains capable of understanding the proceedings and exercising his procedural rights.
The court has now set February 23, 2026, as the date for the “confirmation of charges” hearing. This critical phase will determine if the prosecution has sufficient evidence to move the case into a full-scale trial.
Duterte, who is currently in ICC custody in The Hague following his arrest in March 2025, faces allegations of crimes against humanity stemming from his administration’s controversial “war on drugs.”
Human rights groups estimate the crackdown resulted in thousands of extrajudicial killings by police and vigilantes during his presidency and his earlier tenure as mayor of Davao City.
While the Duterte camp has vowed to appeal the fitness ruling, the ICC’s decision marks a significant procedural victory for the prosecution and the families of victims who have sought international accountability for years.
