Duterte fit to face ICC probe

An independent medical panel has cleared former President Rodrigo R. Duterte for trial, unanimously concluding that he is “fit to participate” in the International Criminal Court (ICC) proceedings.  

The findings, released by the ICC’s Pre-Trial Chamber I, effectively reject the defense’s earlier claims that Duterte’s health and “cognitive impairment” should grant him an indefinite adjournment of the case.  

The panel of physicians confirmed that while the 80-year-old former leader is “frail and elderly,” he possesses the mental capacity required to understand the charges and evidence presented against him. 

This cognitive readiness ensures that he can actively engage with the legal process rather than being sidelined by health concerns.  

The experts also ruled that Duterte is capable of providing clear instructions to his legal counsel and meaningfully exercising his procedural rights. 

The Office of Public Counsel for Victims (OPCV) emphasized that these “clear and unanimous” findings are authoritative and should allow the Chamber to resume the confirmation of charges hearing without further delay.  

However, lead defense lawyer Nicholas Kaufman has already voiced opposition to the report, arguing that the medical experts may not fully grasp the “complex nature” of ICC proceedings. 

Kaufman suggested that while the doctors assessed Duterte’s basic health, they may have overlooked the mental stamina required to navigate thousands of pieces of evidence in a high-level international investigation.  

With this medical clearance, the ICC is expected to move forward with the high-stakes investigation into the Duterte administration’s “war on drugs,” marking a pivotal moment for the international court’s efforts in the Philippines.
