The Department of Labor and Employment (DOLE) announced that the “no work, no pay” rule will apply on October 31, declared a special non-working day under Proclamation No. 727.
In its labor advisory, DOLE said employees who choose not to work will not receive pay for the day, “unless there is a favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day.”
Workers who report for duty are entitled to additional compensation. “For work done during the special day, the employer shall pay the employee an additional 30 percent of the basic wage on the first eight hours of work (basic wage x 130 percent),” DOLE stated.
Those who work beyond eight hours will receive an additional 30 percent of their hourly rate, while employees working on both a special day and their rest day will be paid an extra 50 percent of their basic wage for the first eight hours, and another 30 percent if they render overtime.
